RECREATIONAL CRAFT DIRECTIVE

The Recreational Craft Directive, Directive 2013/53/EU, originally Directive 94/25/EC on recreational craft[1] amended by Directive 2003/44/EC, is a European Union directive which sets out minimum technical, safety and environmental standards for boats, personal watercraft, marine engines and components in Europe. It covers boats between 2.5 and 24m, personal watercraft, engines and a number of components built since 1998. It ensures their suitability for sale and use in Europe. The Directive applies to all craft intended to be used for sporting and recreational purposes with a hull length of between 2.5 and 24 meters. With a number of Exclusions: Regardless the type or length of the hull Design Categories are applied to be designed and built according to the parameters given concerning stability, buoyancy and other relevant essential requirements listed in Annex I of the RCD.

Furthermore, as established by Decision Number 768/2008/EC of the European Parliament and of the council, the whole process is based on eight evaluation procedures (modules) that are applied to the design and manufacturing phases.

Each design category of a craft or component must undergo this conformity assessment procedure. Modules chosen according to the following Table :

RCD Certification Application – Terms & Conditions

IMCB has established RCD Certification Application which defines the responsibilities and rights of the certification bodies and applicants and requirements on the information to be provided by the applicants. It shall constitute an agreement of legal force for certification activities.

Certification agreements shall take into account the responsibilities of IMCB and its clients.

IMCB shall ensure its certification agreement requires that the client comply at least, with the following:

  1. The client always fulfils the certification requirements, including implementing appropriate changes when they are communicated by IMCB;
  2. If the certification applies to ongoing production, the certified product continues to fulfil the product requirements;
  3. The client makes all necessary arrangements for
    • The conduct of the evaluation and surveillance (if required), including provision for examining documentation and records, and access to the relevant equipment, location(s), area(s), personnel, and client’s subcontractors;
    • Investigation of complaints;
    • The participation of observers, if applicable;
  4. The client makes claims regarding certification consistent with the scope of certification;
  5. The client does not use its product certification in such a manner as to bring IMCB into disrepute and does not make any statement regarding its product certification that the IMCB may consider misleading or unauthorized;
  6. Upon suspension, withdrawal, or termination of certification, the client discontinues its use of all advertising matter that contains any reference thereto and takes action as required by the certification scheme (e.g. the return of certification documents) and takes any other required measure;
  7. If the client provides copies of the certification documents to others, the documents shall be reproduced in their entirety or as specified in the certification scheme;
  8. In making reference to its product certification in communication media such as documents, brochures or advertising, the client complies with the requirements of IMCB or as specified by the certification scheme;
  9. The client complies with any requirements that may be prescribed in the certification scheme relating to the use of marks of conformity, and on information related to the product;
  10. The client keeps a record of all complaints made known to it relating to compliance with certification requirements and makes these records available to IMCB when requested, and
  11. Takes appropriate action with respect to such complaints and any deficiencies found in products that affect compliance with the requirements for certification;
  12. Documents the actions taken;
  13. The client informs IMCB, without delay, of changes that may affect its ability to conform with the certification requirements.

Application review

IMCB reviews the applications to ensure:

      1. The applicant organization may obtain open information from IMCB by RCD Certification Application, RCD Certification Regulations, and will understand the rules specified for RCD certification.
      2. The applicant organization has filled the information needed for certification process and product information in the Application Form.
      3. The applicant has provided a written statement that it does not file the same application with other designated organizations at the same time (applicable to Module B)
      4. The applicant organization has provided relevant technical documents and quality system documents as required in the modules in RCD Directive Annex.
      5. Capable of clearly understanding the applicant organization’s certification requirements, resolve the differences in understanding, and reach an agreement on the rights and obligations in relevance to certifications.
      6. All measures for implementation of evaluation activities are feasible. IMCB is competent of performing the certification activities.
      7. In the review, take into consideration the scope of certification, site and other items that might influence the certification activities (language, safety condition, and threat to impartiality).
      8. Keep the records of reasons to decide the implementation of certifications.

IMCB only accepts applications for certifications within the approved professional scope.
